These terms of service (the "Terms of Service") govern the use of this website (the “Site”) and the associated notary public service (the “Service”). This Site is owned and operated by Real Cheap Notary LLC (“Real Cheap Notary”). By using this Site and Service, you indicate that you have read and understand these Terms of Service and agree to abide by them at all times.

THESE TERMS OF SERVICE CONTAIN A DISPUTE RESOLUTION CLAUSE THAT IMPACTS YOUR RIGHTS ABOUT HOW TO RESOLVE DISPUTES. PLEASE READ IT CAREFULLY.

1. Intellectual Property

The website design on the Site is the property of Real Cheap Notary and the Site's creators. This includes, but is not limited to images, text, logos, and anything that contributes to the composition of the Site.

2. Age Restrictions

The minimum age to use this Site is 18 years old. By using this Site, users agree that they are over 18 years old. Real Cheap Notary does not assume any legal responsibility for false statements about age.

3. Acceptable Use

As a user of the Site, you agree to use the Site legally, not to use the Site for illegal purposes, and not to:

- Harass or mistreat other users of the Site;

- Violate the rights of others;

- Violate the intellectual property rights of the Site owners or any third party to the Site;

- Hack into the account of another user of the Site or the Site itself;

- Act in any way that could be considered fraudulent; or

- Post any material that may be deemed inappropriate or offensive.

If Real Cheap Notary believes you are using the Site illegally or in a manner that violates these Terms of Service, Real Cheap Notary reserves the right to limit, suspend or terminate your access to the Site. Real Cheap Notary also reserves the right to take any legal steps necessary to prevent you from accessing the Site.

4. Sale of Services

These Terms of Service govern the sale of services available on the Site.

The following services are available on the Site:

- Remote Online Notary.

The services will be paid for in full when the services are ordered or upon delivery.

These Terms of Service apply to all the services that are displayed on the Site at the time you access it. All information, descriptions, or images that provided about the services are as accurate as possible. However, Real Cheap Notary is not legally bound by such information, descriptions, or images as it cannot guarantee the accuracy of all services provided. You agree to purchase services from the Site at your own risk. Real Cheap Notary reserves the right to modify, reject, or cancel your order whenever it becomes necessary. If Real Cheap Notary cancels your order and has already processed your payment, it will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

Payments

Real Cheap Notary accepts the following payment methods on the Site:

- Credit Card;

- PayPal;

- Square

- Stripe; and

- Debit

When you provide Real Cheap Notary with your payment information, you authorize Real Cheap Notary’s use of and access to the payment instrument you have chosen to use. By providing your payment information, you authorize Real Cheap Notary to charge the amount due to this payment instrument. If Real Cheap Notary believe your payment has violated any law or these Terms of Service, it reserves the right to cancel or reverse your transaction.

5. Refunds

Refunds for Services

Real Cheap Notary provides refunds for services sold on the Site as follows:

- If the Service was performed incorrectly upon submission of proof; and

- If the Service was not performed

6. Consumer Protection Law

Where any consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms of Service will not limit your legal rights and remedies under that legislation. These Terms of Service will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms of Service and that legislation, the mandatory provisions of the legislation will apply.

7. Links to and Use of Third Parties

The Site and Service relies on and links to third party websites or services that it does not own or control. Real Cheap Notary is not responsible for the content, policies, or practices of any third party website or service linked to on this Site. It is your responsibility to read the terms and conditions and privacy policies of these third party websites and services before using them or this Site or Service.

8. Privacy Policy and Consent to Audio-Visual Recording

By using the Site and Service, you consent to the Privacy Policy, and by using the Service you consent to be audio-visually recorded and for the recording to be retained for at least ten years pursuant to New York Executive Law § 135-c(2)(b).

9. Limitation of Liability

To the fullest extent permitted by law, Real Cheap Notary and its members, owners, principals, shareholders, directors, officers, employees, assignees, agents, contractors, and vendors will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site or Service.

TO THE FULLEST EXENT PERMITTED BY APPLICABLE LAW, REAL CHEAP NOTARY DISCLAIMS ANY AND ALL WARRANTIES AND REPRESENTATIONS, EXPRESS OR IMPLIED. THE SITE AND ALL CONTENTS CONTAINED THEREIN AND COMPONENTS THEROF ARE PROVIDED ON AN “AS IS” BASIS AND YOUR USE OF SITE IS AT YOUR OWN RISK.

10. Indemnity

Except where prohibited by law, by using this Site and/or Service you indemnify and hold harmless Real Cheap Notary and its members, owners, principals, shareholders, directors, officers, employees, assignees, agents, contractors, and vendors from any actions, claims, losses, damages, liabilities and expenses including legal or dispute resolution fees arising out of your use of the Site and/or Service or your violation of these Terms of Service.

11. Choice of Forum and Law

Subject to Section 12, you agree litigate any claim or dispute exclusively in the U.S. District Court for the Eastern District of New York as governed by the laws of the State of New York, without regard to conflict of laws principles; or exclusively in any state court of the State of New York located in Suffolk County, New York, or Nassau County, New York, as governed by the laws of the State of New York, without regard to conflict of laws principles. Neither this Section nor Section 12 shall restrict Real Cheap Notary’s nor its members’ choice of law and forum for claims or disputes where lawfully applicable.

12. Dispute Resolution

Subject to any exceptions specified in these Terms of Service, if you and Real Cheap Notary are unable to resolve any dispute through informal discussion, then any controversy or claim brought by you arising out of or relating to this contract, or the breach thereof, shall be settled exclusively by arbitration administered by the American Arbitration Association in accordance with its Commercial [or other] Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

You agree that any dispute resolution or legal proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

The Federal Arbitration Act, 9 U.S.C. §§ 1-16, shall govern the interpretation and enforcement of this Section.

13. Assignment

Real Cheap Notary shall be authorized to assign, transfer, or subcontract its rights and obligations under these Terms of Service without your consent or any notice to you. You shall not be authorized to assign, transfer, or subcontract any of your rights and obligations under this agreement.

14. Severability

If at any time any of the provisions set forth in these Terms of Service are found to be inconsistent or invalid by a court of competent jurisdiction, those provisions will be deemed void and inapplicable. All other provisions will not be affected and the rest of these Terms of Service will still be considered valid.

15. Amendment

These Terms of Service may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way the Site and/or Service is operated and the way users are expected to behave on the Site. Real Cheap Notary will notify users by email of changes to these Terms of Service or post a notice on the Site.
